Section 44 of The Central Provinces Land-Revenue Act, 1881
For the purpose of excluding from all or any of the operations of the settlement any town or any land from which the owner can derive no profit, the Settlement-officer may mark off the site and determine the limits of such town or land: Provided that no land in respect of which land-revenue payable at the date of the notification issued under section twenty-eight shall, under this section, be exempted from assessment without the sanction of the Chief Commissioner.
Summary
- This provision allows the Settlement-officer to leave a town or unprofitable land completely out of the settlement process.
- The officer can physically mark the boundaries and decide the exact limits of the area being excluded.
- This rule is meant for land where the owner cannot make any profit whatsoever.
- However, if land is already required to pay land revenue at the time of the initial settlement notification, it cannot be easily exempted.
- The only way to exempt land that already pays revenue is to get special official permission from the Chief Commissioner.
