Section 3 of The Labour Laws (Simplification of Procedure for Furnishing Returns and Maintaining Registers by certain Establishments) Act, 1988
On and from the commencement of this Act, the Scheduled Acts shall have effect subject to the provisions of this Act.
Summary
- This section states that once this Act starts, the other labour laws listed in the First Schedule must follow this Act's rules.
- This means that the rules in this law override or modify the procedures of those other laws for certain businesses.
- It ensures there is no conflict between the older laws and these new simplified rules.
Practical examples
1On June 1, 1989, Suresh owned a small factory with 12 workers. Under the Factories Act, 1948, he had to file several complex registers. Since Section 3 makes the Factories Act subject to this Act, Suresh can use the simplified registers of this Act instead of the complex ones of the older Act.
2In 2016, Meera ran a small plantation with 15 workers. She wanted to know if she had to keep all the original registers under the Plantations Labour Act, 1951. Section 3 applies, letting her use the simplified rules of this Act instead.
