Section 14 of The Ajmer Tenancy and Land Records Act, 1950
Status of tenant of niji jot.
A landlord may let his niji jot subject to the same restrictions as apply to sub-letting by a hereditary tenant under section 27: Provided that if such landlord lets his land which is niji jot in contravention of the provisions of this section, such land shall cease to be niji jot and the person to whom the land is so let shall become hereditary tenant thereof.
Summary
- A landlord is allowed to rent out land that has been officially marked as niji jot (land for personal cultivation).
- When a landlord rents this land, they must follow the same sub-letting rules that apply to hereditary tenants under Section 27 of the Act.
- If a landlord breaks these rules while renting out the land, the land immediately loses its special status as niji jot.
- If the niji jot status is lost because of a lease violation, the person who rented the land automatically becomes a hereditary tenant.
- The restrictions include renting only to people who earn their living from farming and keeping the lease length to three years or less.
